GDPR Privacy Notice

Under the General Data Protection Regulation (GDPR) and Data Protection Act 2018 you can request access to your personal information. This includes asking for your personal information to be updated, erased or stop being used.

There are two main regimes under which personal information requests may be made to school:

  • The Education (Pupil Information) (England) Regulations 2005 provide a right of access by a parent, to their child’s ‘educational record’.  Schools do, however, have the right to refuse a parent’s request for information in some circumstances; for example, where the information might cause serious harm to the physical or mental health of the pupil or another individual or where the information would not otherwise be disclosed to the child under subject access.
  • The General Data Protection Regulation and Data Protection Act 2018 provide for subject access requests (SARs) to be made by an individual for access to their own personal data.  The right of subject access may also be exercised by a parent on the child’s behalf, where the child is under 12 years or where the child otherwise lacks capacity to exercise this right.  An agent with authority can also act on the data subject’s behalf e.g. a solicitor.
